A 16-year-old girl in Broward County reported her substitute teacher after he allegedly forced her into a sexual act in his car last fall, an encounter that began with persistent messages exploiting his position at her school.[1][2] Authorities later uncovered similar advances toward a second underage student, prompting the man’s arrest last week and raising fresh concerns about oversight in temporary classroom roles. The case highlights the vulnerabilities students face when authority figures cross boundaries.
Initial Contact and Escalating Messages
On October 1, 2025, Marsel Javaris Smith approached the girl as she walked on the campus of Northeast High School in Oakland Park after classes ended. The 27-year-old substitute, who had worked in Broward County Public Schools for about three years through Kelly Education, complimented her and asked for her phone number.[1] She provided it, and soon the texts turned explicit.
Smith requested photos and videos, pressing further when she hesitated. In one message, he wrote, “Dang you making wanna see more videos and pics but a lil more you know exclusive.”[1] When she declined to send more, he assured her, “Trust me everything stays here between us.” Her refusal prompted another reply: “But come on think of everything I be at your school. You can trust me.”[1] These exchanges revealed his reliance on his school presence to build false security.
The Parked Car Encounter
The messages culminated in action on October 19, 2025. After earlier meeting her at a fast-food restaurant on October 14 – where he demanded a sex act she refused – Smith picked up the girl and drove to Oswald Park on Northwest 21st Avenue in Fort Lauderdale.[1] In the back seat of his car, he again requested oral sex. She said no multiple times and made clear she wanted no sexual activity, according to the police report.[2]
Investigators stated that Smith pulled down his pants, grabbed the back of her head, and forced her to perform the act before they had sex. He then dropped her off. Days earlier, at the restaurant, similar pressure had failed, but the park incident marked a severe escalation. The girl avoided him at school afterward, yet he continued attempts to engage her there.
A Second Alleged Target Emerges
While investigating the first report, Broward Sheriff’s Office detectives learned of another underage girl Smith had targeted. During a class he substituted in 2025, he obtained her phone number and texted her requesting a sex act.[1] Few additional details surfaced publicly, as the probe into this allegation remained active.
This pattern suggested broader predatory behavior. Smith had previously taught at Northeast High School before shifting to district-wide substituting. The dual complaints underscored how temporary roles might evade routine scrutiny.
Arrest Follows Renewed School Encounter
Nearly six months later, on April 24, 2026 – the day of his arrest – the first victim spotted Smith in a school hallway. He commented on her hair and asked to speak privately in an empty classroom. She declined and immediately told a school security officer, who alerted authorities.[1]
Smith confirmed exchanging numbers and the fast-food meet during his interview but claimed he could not remember the park trip before ending the session. He faced charges of an authority figure soliciting or engaging in a romantic relationship with a student, plus sexual battery on a 16- or 17-year-old by someone 24 or older. The following day, April 25, a judge set his bond at $30,000 and barred contact with minors or the victims. Broward schools banned him from substituting countywide.[2]

School District Responds Amid Outrage
Broward County Public Schools notified parents that Friday evening. The message described Smith as a non-employee substitute via Kelly Education, arrested for sexual misconduct with a student. Officials expressed disturbance and cooperation with the Broward Sheriff’s Office Special Victims Unit, withholding details due to the ongoing investigation.[1]
The district’s swift ban reflected standard protocol, yet the delay in reporting – spanning months – prompted questions about monitoring substitutes. Families at Northeast High and beyond now grapple with eroded trust in those meant to safeguard students during absences.
This incident serves as a stark reminder of the power imbalances in schools. For the teens involved, the betrayal lingers, while communities await full accountability and stronger preventive measures to protect the vulnerable.
